Mr John Swift QC today issued the following statement:
"I have now served notices under section 58 of the Railways Act 1993 on British Railways Board, Enterprise Rail Ltd., LTS Ltd and Rail Settlement Plan Ltd requiring relevant information to be produced to me by Tuesday next week.
"I intend to carry out a thorough inquiry with efficiency and due process recognising that there is genuine public interest in the Regulator's findings and possible action.
"In investigating a licence breach I am exercising an important statutory function conferred on me by the Railways Act 1993 and it would therefore be inappropriate for me to make any further comment on the investigation while it is in progress.
"I will make a further statement once the investigation has been completed".
