In August Railtrack, and the industry parties involved in the accident, agreed for Railtrack to act as the lead party to consider and settle all claims without the victims and relatives involved in the accident having to prove legal liability.
Railtrack did not want the issue of liability to cause unnecessary stress to those involved and created one point of contact where those affected by the accident could submit claims.
Some payments have already been made but this represents just a small portion of what will be paid. No liability issues stand in the way of claims being lodged, considered and settled.
Some five months after the tragedy, the Health and Safety Executive and the British Transport Police continue their investigation into the cause of the accident. Until this investigation is completed the issue of industry liability cannot be settled.
